Moore Payne Law Files Negligence Lawsuit Against Tradewinds Apartment Hotel After Drowning Death of 5-Year-Old Girl

Orlando, FloridaMoore Payne Law, an Orlando-based law firm specializing in catastrophic personal injury cases, has filed a negligence case, along with attorney Sergiu Gherman, Esq. from Gherman Legal, on behalf of a five-year-old child (“M.A.B.”), who died after drowning in an unsecured pool at the Tradewinds Apartment Hotel in Miami Beach, Fla.

According to the complaint, M.A.B. exited her family’s guestroom in the early morning hours of April 22, 2025, through a defective door that lacked required child-safety features. She then accessed the unsupervised pool through a gate that failed to self-close or latch. The suit claims nine out of 10 gates at the property did not meet Florida Building Code requirements. Surveillance footage revealed the child was visibly struggling in the pool for over eight minutes without intervention from hotel staff, who failed to notice the incident due to a tree blockage on the surveillance cameras, the complaint states. Despite aggressive life-saving measures and medical treatment, M.A.B. tragically succumbed to her injuries on April 26, 2025.

“As a long term resident of Miami, I care deeply about the safety of this city, not just for those of us who call it home but for the families who visit and trust that our community will protect them,” said Gherman. “Children are the most vulnerable members of our society, and they are also our future, we must take all reasonable action to protect them.”

The lawsuit further alleges that the Tradewinds Apartment Hotel and its parent companies, Museum Walk Apartments, LLC and South Beach Group Hotels, Inc., had a long history of noncompliance with pool safety regulations and failed to maintain basic safeguards required by Florida Law. State records and guest complaints point to repeated violations, including operating the pool without a permit, failing to maintain lifesaving equipment, and leaving gates and locks in disrepair.

“We are absolutely devastated by the loss of our sweet daughter,” the victim’s family said. “At only five years old, she had her whole life ahead of her. We came to Miami hoping to create memories as a family, and instead, we are leaving with broken hearts that will never heal.”

The family continued, “what happened to our daughter was preventable. We believe the hotel failed to ensure the pool area was safe and secure for children. No parent should have to endure what we are going through, and we are committed to seeking answers and accountability so that no other family has to experience this pain.”
